NEC Infant Formula Lawsuit

Manufacturers of popular cow’s-milk-based infant formulas face litigation over necrotizing enterocolitis (NEC) in premature infants. If your child was diagnosed with NEC or a serious GI injury after receiving formula, you may be eligible to pursue compensation with help from an experienced attorney.

Necrotizing enterocolitis (NEC) is a serious intestinal condition seen most often in premature or low-birth-weight infants. When intestinal tissue is injured or inflamed, it can lead to perforation, infection, and the need for intensive medical care or surgery.

Some families allege that manufacturers failed to adequately warn that cow’s-milk-based infant formula may pose increased risk compared with human milk in certain vulnerable infants. Lawsuits seek to hold companies accountable where warnings or instructions were allegedly inadequate.

What is NEC?

Necrotizing enterocolitis (NEC) is a condition in which parts of the intestine become inflamed or injured. In severe cases, tissue can die or a hole can form in the intestinal wall, allowing bacteria to enter the bloodstream — a life-threatening situation that may require surgery.

NEC is reported in a meaningful share of very low birth weight infants; outcomes can include surgery and significant mortality in severe cohorts. The exact cause in any one child may be multifactorial; published literature has discussed enteral nutrition type and other clinical factors in preterm infants.

Litigation has focused on manufacturers such as Abbott (Similac) and Mead Johnson (Enfamil), among others, and on whether labeling and marketing appropriately reflected scientific discussion of risks in preterm populations.

Symptoms of NEC

  • Apnea (pauses in breathing)
  • Blood in stool
  • Bradycardia (slow heart rate)
  • Constipation
  • Diarrhea
  • Green vomit (bile-stained emesis)
  • Hypotension (low blood pressure)
  • Lethargy or unusual irritability
  • Low or unstable body temperature
  • Swollen, red, or tender belly
  • Trouble feeding or poor feeding tolerance

NEC treatment

  • Antibiotics
  • Clinical exams and abdominal imaging (e.g., X-rays) as indicated
  • IV fluids and supportive care
  • Nasogastric or orogastric decompression when ordered by the care team
  • Temporary cessation of enteral feedings when clinically appropriate
  • Surgery in severe cases (e.g., resection, ostomy) when necessary

Treatment plans are individualized by neonatologists and surgeons. If you have medical questions about your child’s care, speak with your child’s physician — this page is not medical advice.

Costs of NEC treatment

Hospitalization and surgical care for severe NEC can be very expensive. Peer-reviewed literature has reported wide cost ranges depending on acuity, complications, and length of stay — for example, analyses of surgical NEC have discussed costs in the hundreds of thousands of dollars in some cohorts (see references below).

Past costs do not predict future expenses in any case, and not every child will require surgery. An attorney can help you understand what damages may be recoverable under applicable law.

NEC infant formula litigation

Parents and guardians have filed lawsuits alleging that certain infant formula products were marketed or sold without adequate warnings about NEC risks in preterm or vulnerable infants. Allegations, defenses, and outcomes vary by jurisdiction and case.

If you believe your family may have a claim, a free case review with a qualified attorney can help you understand your options. Victory Legal Network can help connect you with a law firm for that review.
